1. GENERAL

1.1 These terms and conditions apply when you, as a consumer, place an order through www.postersbysouthside.com. By ordering, you enter into an agreement with Posters by South Side, reg. no. SE730601-8891. These terms apply only to consumers ordering via our website.

1.3 All materials (images, designs, etc.) are owned by their respective creators (photographers/artists). Posters by South Side has permission to sell selected materials as printed posters under contractual agreements with the creators.

1.4 Unauthorized copying, reproduction, or distribution of images from our website is prohibited by law. As a consumer or visitor, you are responsible for ensuring images are not misused. In case of unauthorized use, we may seek compensation based on applicable rates, such as those recommended by the Swedish Photographers' Association.

2. USE AND ORDERING FROM THE SITE

2.1 To place an order, you must accept these terms and conditions. By accepting, you agree to comply fully and confirm you have read our regarding the handling of personal data, which complies with the EU General Data Protection Regulation (GDPR).

2.2 You must be 18 years or older to order from www.postersbysouthside.com. If under 18, you need consent from a legal guardian to enter into a purchase agreement, as required by Swedish law.

2.3 Orders will not be processed unless these terms are accepted.

2.4 When ordering, you must provide accurate and complete personal information. You are responsible for any errors due to incorrect details provided.

2.5 You are responsible for keeping your login information secure and preventing unauthorized access. If you suspect unauthorized use of your account, contact us immediately at contact@postersbysouthside.com. You remain responsible for purchases made with your login details unless you promptly notify us of unauthorized access. We implement reasonable security measures to protect your account.

2.6 Upon placing an order, you will receive an order confirmation via email to the address provided. We recommend saving this confirmation for reference. You may cancel your order before receiving the confirmation, subject to our approval.

3. OFFERS AND PROMOTIONS

3.1 We may offer temporary promotions or discounts for specific products, valid only for the duration specified. Posters by South Side reserves the right to modify or withdraw offers at any time, with notice provided on our website where possible.

4. GIFT CARDS

4.1 Gift cards are valid for 12 months from the date of purchase, unless otherwise stated, in accordance with Swedish law.

4.2 Ensure you provide accurate contact details for the gift card recipient. We are not responsible for errors in delivery due to incorrect information, unless caused by our negligence.

4.3 Gift cards cannot be exchanged for cash.

4.4 Promotions or discounts cannot be applied to gift card purchases.

4.5 We are not liable for lost, stolen, or damaged gift cards unless the issue results from our fault (e.g., a security breach). Please contact us immediately if you suspect unauthorized use.

5. PRICES, FEES, AND PAYMENT

5.1 Prices displayed on www.postersbysouthside.com at the time of your order apply. All prices include VAT and are stated in your chosen currency.

5.2 If a pricing error occurs (e.g., a typographical mistake), we will contact you to confirm whether you wish to proceed at the correct price or cancel the order. If we cannot reach you within 10 days, we may cancel the order and notify you.

6. DELIVERY

6.1 We aim to deliver orders within 5–10 working days from confirmation, unless otherwise agreed. Delivery times may vary due to high demand or unforeseen circumstances, and we will inform you of any delays.

6.2 If you fail to collect your package within the timeframe specified in the delivery notification, we may charge a fee of SEK 150 to cover handling costs. This fee is clearly displayed during checkout. Packages typically require valid ID and the order/avis number for collection.

7. RIGHT OF WITHDRAWAL

7.1 For standard posters (pre-designed and not personalized), you have a 14-day right of withdrawal from the date you receive the goods, as required by the Swedish Distance and Doorstep Sales Act and EU Consumer Rights Directive. To exercise this right, contact us at contact@postersbysouthside.com within 14 days, and return the unused product in its original condition. You are responsible for return shipping costs unless otherwise agreed.

7.2 For customized products (e.g., posters printed with customer-specified designs, sizes, or other personalizations), the right of withdrawal does not apply, as these are made to your specific request under the Swedish Distance and Doorstep Sales Act (§ 5). We will clearly indicate during checkout if a product is customized.

7.3 Refunds for valid withdrawals will be processed within 14 days of receiving the returned goods, using the original payment method.

8. COMPLAINTS

8.1 You may file a complaint for products with manufacturing defects, as covered by Swedish consumer protection laws. Complaints do not apply to defects caused by personal modification, misuse, or negligence.

8.2 If you receive an incorrect or defective order, contact us at contact@postersbysouthside.com as soon as possible, preferably within 14 days of receipt.

8.3 For approved complaints, we cover return shipping costs and will replace the product or issue a refund at your choice.

8.4 We aim to process refunds within 14 days of approving a complaint, but it may take up to 30 days depending on the product’s nature. You will be informed of any delays.

8.5 We comply with decisions from the National Board for Consumer Disputes (ARN, www.arn.se). If a product is found not defective under consumer law, we may deny the complaint.

9. CHANGES TO THE TERMS AND CONDITIONS

9.1 We may update these terms at any time. Changes will be posted on www.postersbysouthside.com and, for significant updates, communicated via email or a website notice. Changes take effect when you accept the updated terms (e.g., by placing a new order) or 30 days after notification.

9.2 You are responsible for reviewing the terms periodically. Orders placed before changes are effective remain subject to the terms at the time of purchase.

10. APPLICABLE LAW AND DISPUTE

10.1 We aim to resolve disputes amicably through our customer service team at contact@postersbysouthside.com.

10.2 If a dispute cannot be resolved, you may refer it to the National Board for Consumer Disputes (ARN, www.arn.se) or the EU’s Online Dispute Resolution platform (ec.europa.eu/odr). We follow ARN’s recommendations in all cases.

10.3 These terms are governed by Swedish law.

11. FORCE MAJEURE

11.1 We are not liable for delays or failures to fulfill orders due to events beyond our control, such as natural disasters, war, or other extraordinary circumstances. In such cases, we will notify you promptly and offer a refund or alternative solution where possible.
